Are hawks protected in Florida? Yes, hawks are legally protected in Florida under both federal and state laws. The Migratory Bird Treaty Act (MBTA) of 1918 makes it unlawful to pursue, hunt, take, capture, kill, or sell hawks and other migratory birds without proper authorization. This federal protection applies to all native hawk species in Florida, including the red-shouldered hawk, which is commonly found throughout the state.
